TERMS AND CONDITIONS

The following Terms and Conditions apply to lesson agreements made between Up Tempo Music Lessons LLC (“Up Tempo”) and its students and the parents/caregivers of its students (“the student”).
The Terms and Conditions outlined below may seem strict, but the Up Tempo team has thoroughly discussed them to ensure they are fair for both clients and providers. As a small business operating with minimal margins, we have had to establish these guidelines to protect our organization. They primarily address a small group of individuals who have taken advantage of our services without payment, which jeopardizes the livelihoods of our instructors and managers.
We approach each situation with good faith and an open mind and encourage you to do the same. While there may be instances where the terms favor Up Tempo, there will also be occasions where they favor the student or caregiver.
Communications

All correspondence is sent out to the student by email or text. If this causes a problem, please let Up Tempo know.

The student is responsible for making Up Tempo aware of any changes to their contact details.

Up Tempo will not be held responsible for any missed communications, late/overdue payments, missed lessons, etc., if this is due to incorrect contact information.

Due to the size of our student roll, most of Up Tempo’s communication is done via bulk delivery services, e.g., mail merge. Therefore, there is a level of potential error associated with this.

If you notice something incorrect, e.g., lesson or account details, it is not meant offensively. In these cases, please email info@uptempolessons.com so we can rectify the situation as soon as possible.
Student Conduct

Students are expected to treat their fellow students and instructors respectfully and refrain from disruptive or inappropriate behavior during the lesson.

Any inappropriate behavior, such as disrespect, aggression, or harassment toward other students or staff, may result in immediate termination of the lesson agreement.

Up Tempo Music Lessons reserves the right to terminate a lesson agreement for any reason deemed necessary, including but not limited to inappropriate behavior from students or parents, chronic tardiness or absenteeism, or failure to make timely payments.
Studio Lessons
Term Dates
Teaching weeks at Up Tempo roughly adhere to the Sioux Falls Public School District Calendar. However, there may be occasional deviations. Term dates will be provided before the start of each term.
The tuition rates are determined based on a full calendar school year of 32 weekly lessons. Some months have a lesson every week, while others may have only two lessons, depending on holidays and breaks. Please note that monthly tuition is calculated based on the imbalance in the number of lessons provided each month. Tuition is set at a fixed rate, regardless of the actual number of lessons given that month.
Up Tempo Music Lessons strives to maintain a schedule that respects the time and commitment of our students and the Up Tempo team. The following cancellation policy ensures smooth operations while remaining fair and transparent.
Student Cancellations
Students must cancel their lesson with at least 24 hours’ notice to be eligible for a make-up credit. Cancellations made with less than 24 hours’ notice, or lessons missed without notice (“no-shows”), will be forfeited and are not eligible for credit or rescheduling.

Students will receive two make-up credits per semester.

Group Lessons & Private 30-Minute Lessons

The make-up credit is in the form of one private 30-minute lesson based on the instructor's availability.

Private 45-Minute Lessons

The make-up credit is in the form of one private 30-minute lesson based on the instructor's availability.

If a time cannot be found during the semester, the make-up lesson can be scheduled during the make-up week at the end of the semester.

The fall semester goes from August to December, and the spring semester from January to May.

The cancellation must be received with at least a 24-hour notice for a make-up credit.

After the first cancellation, all canceled lessons, even with notice, will be forfeited.
Staff Cancellations
If a member of the Up Tempo staff needs to cancel a lesson, the student will receive one (1) 30-minute or (1) 45-minute private lesson credit corresponding with the student's lesson subscription. This does not go towards the lesson credit limit for student cancellations.
All staff-issued credits must be used during the semester and are scheduled based on staff and room availability. If a time cannot be found during the semester, the make-up lesson can be scheduled during the make-up week at the end of the semester. These credits do not roll over and are not transferable or refundable.
Illness, Emergencies & Weather
We understand that illness, emergencies, and weather-related issues can arise unexpectedly. These situations will be considered in good faith, and if approved, a make-up credit may be issued and count toward your one-credit limit for the summer semester. Exceptions are made at the studio’s discretion, and prompt, clear communication is always appreciated.
How to Cancel
Cancellations can be submitted by:
• Logging into the student portal
• Calling or texting the studio
• Emailing Up Tempo directly
Withdrawing from Lessons

Enrollment at Up Tempo Music Lessons is for the full school year. By signing up in the fall, families are financially committed through the end of the fall semester.

Students are automatically enrolled in the spring semester unless they submit a written notice of withdrawal by December 15. If we do not receive notice by that date, you will be committing to lessons through the spring semester, and the full year’s tuition will be billed accordingly.

During the spring semester, Up Tempo requires a 30-day notice to withdraw from lessons. Students will be billed accordingly based on their notification date.

Music Play
Tuition for 8-week sessions is paid in full at the time of enrollment. Because these sessions are short-term and scheduled in advance, we do not offer makeups, credits, or refunds for missed lessons due to student absence. In the rare event that an instructor must cancel a lesson and we are unable to reschedule it, a prorated refund will be issued for that missed lesson.
Changes to the Terms and Conditions
The Terms and Conditions described above are agreed to upon enrollment and may be changed at any point by Up Tempo without providing notice to the student.
A copy of the Terms and Conditions will always be available on our website and may be emailed to the student on request.
